The family of a woman, Atifa Tabasum of Wanpora village in Kulgam district, has been forced to defer her wedding scheduled for Sunday after police did not release her incarcerated father, who had been detained under the Public Safety Act.

Although the High Court had quashed his second PSA detention order last week, the police did not release him.

Atifa, who is the eldest daughter of 62-year-old Tehreek-I-Hurriyat district president for Kulgam Muhamad Shaban Dar, was scheduled to get married on Sunday as the family was anticipating his release.

“The court quashed his PSA early last week and we were expecting his release soon. That is why we fixed October 22 as the date of wedding. We have now fixed October 26 as the new date,” says Dar’s wife Naseema Akhtar. She said her daughter has been engaged for two years now.

 “If he is not released we would be left with no option but to go ahead with the wedding without him,” said Naseema.

After the court quashed his PSA last week, the sleuths of Counter Insurgency Kashmir (CIK) took him into their custody from the Central Jail.

Dar was arrested on November 9 last year, booked under the PSA and shifted to Kotbalwal jail in Jammu.

His PSA was quashed in June this year, but the authorities did not release him and instead detained him again under the PSA, which allows the police to detain a person without a trial for six months. However, it has been noticed that once released, this draconian piece of legislation is again used to detain the released person, sometimes outside the court.

In August, Dar was shifted to Central Jail Srinagar.

“Dar has 23 FIRs against him for participating in protests in Kulgam district during last year’s summer uprising,” says his family while accusing the government of prolonging his detention.

They said that as they get bail from a court for one FIR, police comes up with more cases.
